By accessing and using CaseNotePro ("the App", "the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and CaseNotePro ("we", "our", "us") regarding your use of the Service.

CaseNotePro is a mobile application designed to help social workers, counselors, and human services professionals create, manage, and organize professional case notes and documentation.

The Service includes features such as:

• On-device storage with optional biometric security
• Professional templates and documentation tools

3. User Responsibilities

Professional Use

You agree to use CaseNotePro for professional purposes only and in accordance with:

• Applicable laws and regulations
• Professional ethics codes and standards (e.g., NASW, ACA, licensing board requirements)
• Your employer's policies and procedures
• Privacy and confidentiality requirements (e.g., HIPAA, state privacy laws)

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• Enabling device security features (passcode, biometric authentication)
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Data Controller Obligations

As a user of CaseNotePro, you acknowledge that:

• You are the data controller for any client or third-party information you enter
• You have lawful authority to collect and process such information
• You have obtained necessary consents from clients where required
• You are responsible for compliance with applicable data protection laws

Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose

4. Intellectual Property

Our Rights

The Service, including all software, text, graphics, logos, and other materials, is owned by CaseNotePro and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the App for your personal professional purposes in accordance with these Terms.

Your Content

You retain all ownership rights to the content you create using CaseNotePro, including case notes and professional documentation.

As outlined in our Privacy Policy, your content is stored locally on your device and is not uploaded to our servers unless you explicitly use cloud-based features (such as transcription).

5. Subscriptions and Payments

Subscription Terms

CaseNotePro offers subscription-based access to premium features. Subscriptions automatically renew unless canceled before the renewal date.

Payment Processing

Payments are processed through Apple's App Store. All billing, refunds, and subscription management are subject to Apple's terms and policies.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellations take effect at the end of the current billing period.

Refunds

Refund requests must be made through the App Store and are subject to Apple's refund policies.

6. Disclaimers and Limitations

Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Professional Judgment

No Guarantee of Accuracy

While we strive for accuracy in transcription and AI-powered features, we do not guarantee that these features will be error-free. You must review and verify all generated content before use.

Service Availability

We do not guarantee uninterrupted or error-free operation of the Service. We may modify, suspend, or discontinue any aspect of the Service at any time.

7. Limitation of Liability

To the maximum extent permitted by law, CaseNotePro and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or other intangible losses
• Damages arising from your use or inability to use the Service
• Unauthorized access to or alteration of your content
• Errors or inaccuracies in AI-generated or transcribed content
• Any professional consequences arising from use of the Service

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless CaseNotePro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or professional standards
• Content you create or store using the Service

9. Data and Privacy

10. Termination

By You

You may stop using the Service at any time. You may delete your account and all associated data by uninstalling the App. All locally stored data will be permanently deleted and cannot be recovered.

• Required by law or legal process
• We discontinue the Service

11. Modifications to Terms
